Short Description:

 

The course syllabus contains the following subjects approximated by their historical evolution from Roman, Byzantine, post-Byzantine to modern law:sources of Roman, Byzantine and post-Byzantine law (Latin occupied territories), basic legal concepts (rights, legal personality, legal acts, etc.), inheritance law: intestate succession, testate succession, law of property: general concepts, restrictions of ownership, possessions, praedial and personal servitudes, security interests (pledges,hypothecations), law of obligations: categories of contractual or non-contractual obligations, categories of contracts, commercial law: commercial operations, commercial acts, companies: statutes, categories, characteristics. Labour as a key factor of production: professional associations, labour theories, employment contracts, service contracts, works contracts. Judicial systems, means of evidence, imposing sanctions. In addition, per course, reference is made to the corresponding legal terminology (historical development, Latin legal terms).

Objectives - Learning Outcomes:

 

  • Systematic presentation and analysis of basic principles of law, legal concepts per branch of law, and their historical evolution, in the context of acquiring knowledge, familiarization, understanding and consolidation by students
  • Development of skills of appropriate legal terminology choices when performing the translation work
  • Ability to use legal concepts in different concepts
  • Development of the skills regarding value judgment at a legal level
  • Development of skills in choosing accurate legal terminology during the translation process
Syllabus:

Week 1: Law branches, judicial institutions during Antiquity, rights: categories, acquisition, protection, limitation. Properties of natural and legal persons.

Week 2: Legal transactions: types of legal acts, validity conditions.

Week 3: Intestate and testate succession

Week 4: judicial institutions in Ancient Rome, Possession, ownership, ownership restrictions, ways to acquire ownership, rights, slavery.

Week 5: Pledge, mortgage, categories of obligations, contract categories.

Week 6: Purchase contracts, loan contracts, lease contracts.

Week 7: Debt Assignment Contracts, Warranty Contracts.

Week 8: Commercial operations, branding principles, unfair competition.

Week 9: Companies: statutes, categories, characteristics.

Week 10: Companies: capital, shares, colleges, liabilities of partners, liquidation.

Week 11: Work: categories, conditions, remuneration, rights and obligations of employers and employees.

 

Week 12: Theories of Labor (Labor Theory of Value, Economic Growth Theory etc.).


Week 13: Employment contracts, service contracts, work contracts.

Face to face/ The course has the form of a lecture, which includes dialogue with students to solve questions and comment. Use of audiovisual material.

Evaluation Methods:

 

Written exams. Optional Work: analysis and deepening of terms, concepts, subjects from the issues given. Assignment of essays on legal concepts and issues, inter alias essays on notarial archives of Venetian territories. Mandatory presentation (ppt) of students essays to the class.
